Currently - although the law will change in the near future once the provisions of the Charities Act 2006 are brought into force - in order to register an organisation as a charity, it is necessary to satisfy the Charity Commissioners that the purposes of the organisation fall entirely under one or more heads of charity. These are:

  • the relief of poverty
  • the advancement of education
  • the advancement of religion, and
  • other purposes beneficial to the community.

The legal structure of the organisation which forms the charity can be:

  • a company limited by guarantee
  • an unincorporated association (such as some types of clubs), or
  • a trust.
